What is USPTO?
USPTO stands for the United States Patent and Trademark Office, which is an agency in the U.S. Department of Commerce that deals with issuing patents and trademarks for inventions by either individuals or business entities and intellectual property protection respectively.
It is based in Alexandria, Virginia from the previous location in its neighbourhood, in Arlington, Virginia. The head of the office is the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.
It cooperates with the EPO which stands for the European Patent Office and the JPO, that is the Japan Patent Office as one of the Trilateral Patent Offices it deals with. This institute also functions as an International Preliminary Examination Authority, and an International Searching Authority. Along with these, it deals with international patent applications filed following the Patent Cooperation Treaty.
Along with patents and trademarks, it deals with copyright protection and is one of the unique federal agencies as it totally depends on fees collected from the users and not on taxpayers’ money. It is similar to a business operating structure in which one accepts money in exchange for services which are providing a platform for applications of patents, trademark registration, the steps for follow-up, requirements briefing, etc. The charges or fees cover the cost of performance of these services that this institute provides.
USPTO and Artificial Intelligence
In 2020, Laura Peter, Deputy Under Secretary of Commerce for Intellectual Property and Deputy Director of the USPTO added the views on AI as “New AI technologies demand careful consideration in light of current intellectual property laws,” which represents the concerns that develop with advancements.
In response to this, USPTO solicited public input concerning this, which in return received up to 200 unique comments from experts hailing from different fields such as foreign patent offices, academia, software, automobile law firms, companies in the electronics bar associations, pharmaceutical industries, and medical industries.
Another important discussion that USPTO provided the public to feed their thoughts and share their views is whether the idea of complete decision making based on artificial intelligence results instead of human involvement on copyright, trademark and other intellectual property rights is better or not. This was to understand and analyse their views to gather information about the impact of AI if it performs tasks related to specific questions of copyright-infringing works.
The question starts by asking for public opinion as to whether a result made by AI without any involvement of the human mind and creativity should qualify as authorship protected under US copyright law or what degree of human involvement is optimum for a work to qualify for copyright protection.
